Terms and Conditions
The terms that apply when you use our website and services.
These Terms and Conditions govern your use of the website derassociatesltd.site and any engagement with DER Associates Ltd. By using this website, you agree to these terms.
1. About us
This website is operated by DER Associates Ltd, registered in England & Wales, with its address at 15 Gosse Close, Hoddesdon, Hertfordshire, England, EN11 9FG, United Kingdom. Contact [email protected] or +48 884 859 418.
2. Use of the website
You agree to use this website lawfully and not to misuse it. All content is owned by or licensed to us and may not be reproduced without permission.
3. Information provided
Information on this website is provided for general guidance and does not constitute a binding offer or professional advice. Any proposal or quotation is subject to a written agreement.
3a. What we are not
We are not an entertainment or theatrical agency, a casting service, a model agency, an employment agency or an employment business within the meaning of the Employment Agencies Act 1973. We do not represent performers or other individuals, we do not find or seek to find employment or engagements for anybody, and we do not charge any individual a fee for representation, for finding them work, or for inclusion on any list. Our work in connection with the performing arts is support activity only: coordination, scheduling, logistics and liaison on behalf of the organisation putting on the production.
In sport we organise and run activities for adults. We do not hold ourselves out as qualified coaches or instructors, we claim no affiliation to, or qualification or licence from, any national governing body, and we do not provide activities for children or for adults at risk. Work with children or adults at risk is regulated activity carrying safeguarding, enhanced disclosure and governing-body obligations, and we do not undertake it through this website or otherwise unless those obligations are in place and the engagement expressly covers them. Participants take part in physical activity at their own risk and are responsible for ensuring they are fit to do so; nothing on this website is medical, health or fitness advice.
Our consultancy is management consultancy and expressly excludes financial management. We are not authorised or regulated by the Financial Conduct Authority, and we give no financial, investment, tax, accountancy, legal or insurance advice. Where a matter requires a regulated, licensed or qualified person, we will say so and decline the work.
3b. Engagements
Scope, deliverables, dates and fees are agreed in writing before work begins, and work outside that scope is quoted separately. Recommendations are for the client to decide upon and act on. Where an event or activity is involved, responsibility for the venue, for insurance, for licences and permissions and for statutory duties rests with the party on whom the law places it, and nothing in these terms transfers a duty the law puts on someone else. The client is responsible for the accuracy of information supplied to us. Where we process personal data on a client’s behalf, that is governed by a separate written agreement. Nothing on this website is advice for your particular situation.
4. Liability
Nothing in these terms excludes or limits our liability where it would be unlawful to do so, including for death or personal injury caused by negligence, or for fraud. Subject to that, our liability in connection with this website is limited to the fullest extent permitted by law.
5. Privacy
We process personal data in accordance with our Privacy Policy.
6. Governing law
These terms are governed by the laws of England and Wales, and any disputes are subject to the exclusive jurisdiction of the courts of England and Wales.
7. Changes
We may update these Terms from time to time. The version published at the time of your visit applies.
